Bulging and Herniated Discs – Houston Bicycle Accident Lawyer

The insurance company may deny a claim for herniated disc, classing the injury as a pre-existing injury.

Spinal injuries are common in car accidents and often require immediate hospitalization. However, there may be no immediate symptoms or any visible evidence of a spinal injury. In such cases, pain in the spine could be caused by a herniated disc and present itself after the accident.

Spinal injuries caused by car accidents that do not show up immediately are difficult to prove and claim. Insurance companies tend to categorize them as pre-existing injuries and degenerative, especially in cases where the car accident victim suffers from other arthritic or degenerative conditions as well. If you have suffered a herniated disc injury from a car accident, it is important to have a clear understanding of degenerative bulging and herniated spinal discs and to be able to differentiate between the two.

Bulging and Herniated Discs – Houston Bicycle Accident Lawyer

The discs of the spine are the protective cushions in between the vertebrae. These discs are made of two layers:

  1. Annulus fibrosis – The annulus fibrosis is the outer shell of tough, fibrous cartilage that is flexible to allow movement and while holding the vertebrae together.
  2. Nucleus pulposus – The nucleus pulposus comprises the inner part of the spinal disc made of soft cartilage, serving as a shock absorber that supports the weight of the body and also maintains the structural integrity of the spinal column.

Causes of Bulging Disc and Herniated Disc – Houston Bicycle Accident Lawyer

The terms, bulging disc and herniated disc, are often used interchangeably, even though they have different causes.

  1. Bulging discs – In bulging discs, the entire disc bulges out of its normal place. It is the annulus fibrosis that often bulges out and is commonly caused by aging and is usually degenerative in nature. Bulging discs are mostly painless.
  2. Herniated discs – Herniated discs are the protruding nucleus pulposus from a crack in the annulus fibrosis. A herniated disc is a ruptured or a slipped disc and is the result of trauma.

The Difference Between Bulging Disc and Herniated Disc – Houston Bicycle Accident Lawyer

The difference between a herniated disc and a bulging disc can be determined by the kind of tear seen in the annulus fibrosis by conducting an MRI scan, a discogram, or by observing how the disc reacts in the presence of a tear. Any tear occurring in the annulus fibrosis can alter the shape of a disc; however, it is the pattern of the tear that indicates if the cause is trauma-related or related to disc pathology – recent or pre-existing. There are two types of tears that are usually seen.

  1. Circumferential tears – Circumferential tears are chronic in nature and occur due to prolonged stress or strain wherein the layers of the annulus fibrosis separate.
  2. Radial tears – Radial tears occur due to trauma when the nucleus pulposus cannot bear or absorb the shock (either in a fall or a car accident).

How Drinking Affects Your Driving – Houston Bicycle Accident Lawyer

Elevated blood alcohol levels affect a person’s motor skills.

Have you ever noticed a police officer asking a driver to walk straight line? Usually this happens when the police suspect a driver to be under the influence of alcohol. For this reason, some drivers are pulled over to submit a breathalyzer test to find out if their blood alcohol content (BAC) is within permissible limits. An elevated blood alcohol level affects a person’s motor skills and different BAC levels have different effects on the human body.

How is the Alcohol Level in the Body Measured? – Houston Bicycle Accident Lawyer

A driver’s BAC is measured using a breathalyzer. BAC is a measurement of the amount of alcohol in a person’s breath or in one’s bloodstream. The higher the BAC, the more alcohol a person has consumed and the more intoxicated he or she becomes. The BAC test measures alcohol content in grams per 100 ml of a person’s blood or210 liters of a person’s breath. The legal limit of BAC is .08. 1. BAC 0.020-0.039% – The person becomes less shy than usual and may feel mild euphoria and relaxation. Some may even experience mild lightheadedness.
  2. BAC 0.040-0.059% – The person starts experiencing all previously mentioned effects more intensely. Their caution and judgement are reduced and reasoning and memory may also begin to decline.
  3. BAC 0.06-0.099% – The physical effects of alcohol become more intense, and the person may experience some loss of balance and may begin to lose some motor function. Even the vision and speech becomes impaired. The person may feel a strong sense of euphoria, and memory and reasoning decline further.
  4. BAC 0.100-0.129% – Speech becomes slurred and motor functions become significantly impaired. Judgement deteriorates, vision blurs, reaction time is lowered, and peripheral vision is reduced. There is also some hearing loss.
  5. BAC 0.130-0.159% – The driver no longer feels euphoria and starts experiencing dysphoria or a feeling of being unwell. The person has difficulty walking and speaking properly.
  6. BAC 0.160-0.199% – The person starts experiencing feeling of being unwell and nausea.
  7. BAC 0.200-0.249% – The person becomes completely unaware and confused. He or she may have difficulty moving without help. Nausea and dysphoria become intense and the person may vomit or blackout.
  8. BAC 0.250-0.399% – This stage is referred to as alcohol poisoning and the person may become unconscious.
  9. BAC 0.40% and up – At this stage, there is a high risk of respiratory arrest and the person may enter a coma.

Intersection Bicycle Accidents – Houston Car Accident Lawyer – RJ Alexander Law PLLC

Although one wouldn’t believe that legally crossing the street at an intersection would reduce the amount of bicycle accidents that occur we unfortunately have a large number of drivers in the city of Houston, who do not understand or obey basic municipal traffic laws. Catastrophic injury ranging from broken bones, the facial disfigurement, dramatic brain injury, paralysis, and even death are far too common results when car and bicycles collide. Worse still, by crashes happen far too often, according to the United States Department of Transportation, over 50% of all bicycle accidents take place on major roadways. 2% of all traffic injuries and deaths of all cyclists. The city of Houston pedals into the future with Bicycle Master Plan

Houston Bike Injury Lawyer RJ Alexander Law PLLC

Providing the Houston bicycle community with effective advocacy in and out of the courtroom.

While the death of Chelsea Norman and the resulting trial of her killer has rocked the conscience of automobile drivers throughout the city of Houston, local cyclist are still being maimed and killed by negligent drivers.

“According to Executive Director of BikeHouston, Michael Payne, Houston is in the bottom quartile compared to our city’s size and transportation infrastructure peer group, in terms of investment in terms of things like collisions between people driving cars and people riding bikes.”

However, it seems that Houston is now steadily pedaling into the future as city Council has approved the first bicycle master plan in over 20 years.

“The plan, Payne, says would incorporate traffic studies with ideas from writers about what type of improvements they want to see, where they live, where they worked, and where they want to bike. Ultimately, the hope is that at the end of the planning process, the city will have a concrete list of priorities to tackle, like street improvements in well-defined networks designed to help cyclist safely travel the city.”

Payne along with a number of local community leaders have strongly advocated for the incorporation of bicyclists’ safety concerns and needs. This friendly and vocal entourage has helped to establish connected trail systems, bicycle passing ordinance, and a dedicated bike lane on Lamar Street in downtown Houston.

Due to the size of a city like Houston (you can fix the entire island of Oahu, Hawaii in Houston), it will take quite some time before a bicyclist can safely travel from one local neighborhood to the next.

“According to the funding scheme laid out in the city Council ordinance, the city will ship in $125,000 to hire an outside consultant to develop the plan, while bike Houston has agreed to kick in $100,000. It’s raised for the plan. The Houston Parks Board and H GAC have chipped in 25,000 and $125,000, respectively.”

People have no shame: Stealing Ghost Bikes in Houston

Houston Bicycle Death Lawyer RJ Alexander Law PLLC

Texas Bicycle Death Lawyer fighting for families and loved ones killed by driver negligence.

Have you noticed white bikes placed along roadways as you drive around the city of Houston? Well, those bicycles serve as memorials for Houston cyclists who were killed while riding through our city.

Unbelievably, someone is stealing the bikes after they have been placed at the fatal site of the bicyclist’s death. Steve Sims, one of Houston ghost bikes members, stated that the bikes that a been reported missing didn’t have plaques, flowers, or a ghost bike sticker attached.

“‘It’s possible that whoever took the bike just didn’t know what it means. We’re making sure to add every thing to the replacing bikes,’ since Sam’s, adding that the best have been in what are called hire crime areas.'”

A recent news report estimates the number of missing bikes at just over a dozen.

Although it is possible that the person or persons who are taking a bikes does not know that they are bike memorials that idea is highly unlikely because the bikes are completely spray-painted white; there are no gears left on the bikes; the bike chains are removed; and the bike frame itself is welded in a way that makes it impossible to ride.

If you see someone removing a completely white bike in the future from a sidewalk area or tree do not attempt to confront the person, but please call the Houston Police Department, so that an officer may promptly investigate the situation.

Houston steps into 21st century with Lamar Street bicycle lane

Houston Bicycle Accident Lawyer – RJ Alexander Law PLLC

The city of Houston commonly known for its nonexistent zoning laws and sprawling concrete roadways has begun to make the leap into providing adequate bicycle infrastructure for downtown Houston cyclists. Over the course of the past weekend, construction crews begin the installment of a two-way bike lane on Lamar Street.

The dedicated bike lane on the Lamar Street features traffic signals in both directions, small barriers to alert automobiles of possible encroachment, and is outlined in white paint. The Houston bike lane is also painted a light green to alert onlookers in vehicles and pedestrians that the lane is reserved for Houston bicyclists.

The scheduled completion for the new bicycle infrastructure item is March 8, 2015.

Local bicycle organizations, Bike Houston and B-Cycle, and Houston bicycling enthusiasts are happy to see new developments that will safely allow cyclist to cross between Houston’s various bicycle trail systems. The dedicated bike lane seeks to connect the Buffalo Bayou, Columbia Tap, and Brays Bayou area trails.

Houston Bicycle Accident Lawyer – RJ Alexander Law PLLC

Given the high profile nature of a recent Houston wrongful death bicycle accident case, this measure was long overdue. As more bicyclists move closer into the Houston downtown area and people begin to see the positive effects of cycling to work, it is highly likely that more people will begin to incorporate active lifestyle measures such as bicycling into the everyday lives. Additionally, the fact that the city of Houston enjoys relatively mild winters means that more people are able to cycle throughout the year.

It is important to remember as we move forward with proper road planning that all Houstonians’ lives matter; whether they drive a E-class Mercedes Benz or a Schwinn 10 speed to work.

Bike Lives Matter.
